Gregory Vaughn Hill Jr, 30, was fatally shot by police who responded to a noise complaint in Fort Pierce, Florida.
The 30-year-old was found dead with a gun in his back pocket and toxicology reports showed he was drunk when he died.
One of two sheriff’s deputies on the scene Christopher Newman shot Mr Hill three times.

Last week jurors decided Mr Newman had not used excessive force but said County Sheriff Ken Mascara had acted negligently following the shooting.
The jury awarded $4 in damages made up of $1 for funeral costs and $1 for each of Mr Hill’s three children, the New York Times reported.
The award was reduced to just 4 cents after the jury said the sheriff’s office was only one per cent to blame for the shooting.
In a statement posted on Facebook Mr Mascara said: “Deputy Newman was placed in a very difficult situation, and like so many fellow law enforcement officers must do every day, he made the best decision he could for the safety of his partner, himself, and the public given the circumstances he faced.
“We appreciate the jury’s time and understanding.”

The jury decided on the $4 award after 10 hour deliberation.
